Terms of Service
Welcome to LMX Synthetic (“LMX Synthetic,” “we,” “us,” or “our”), a synthetic intelligence creative platform operated by LMX Studio, a Pennsylvania sole proprietorship (“Company”). These Terms of Service (“Terms”) govern your access to and use of lmxsyntheticai.com and all associated tools, including Designer, Identity Clone, Movie Director, Promote, Edit Lab, ASMR Studio, and Library (collectively, the “Service”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that you are 18 years of age or older and that you have the legal capacity to enter into these Terms.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@lmxstudio.com if you suspect unauthorized use of your account.
3. The Service
LMX Synthetic provides AI-powered content generation tools that allow you to create images, video, audio, and related creative content (“Generated Content”) based on your prompts, uploaded reference materials, and selected settings. The Service uses a combination of proprietary and third-party AI models to produce Generated Content.
We may add, modify, suspend, or discontinue any tool or feature of the Service at any time, with or without notice.
4. Subscriptions, Tokens, and Payment
4.1 Plans. The Service is offered on a free tier and various paid subscription tiers, each with a defined monthly token allowance, as described on our Pricing page at the time of your purchase.
4.2 Billing. Paid subscriptions are billed in advance on a recurring monthly basis through our payment processor, Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
4.3 Tokens. Tokens are consumed each time you generate content and do not roll over between billing periods unless otherwise stated. Free-tier usage is subject to daily limits described in the app.
4.4 Cancellation. You may cancel your subscription at any time through your Dashboard or Settings. Cancellation takes effect at the end of your current billing period; we do not provide partial-period refunds except where required by law.
4.5 Price Changes. Launch-period pricing is offered for a limited time and is subject to change. We will provide notice before any price increase affecting your active subscription.
4.6 One-Time Purchases. Trial or one-time purchases (such as introductory trial access) are non-recurring and are not eligible for renewal-based refunds, as no subscription is created.
5. Acceptable Use
You agree not to use the Service to:
- Generate content depicting any real, identifiable minor in any sexualized, exploitative, or abusive context, under any circumstances.
- Generate content depicting any real, identifiable adult person — including using our Identity Clone or similar likeness-based tools — without that person’s explicit knowledge and consent. You may only upload your own likeness or the likeness of individuals who have given you permission to do so.
- Generate content that is illegal, defamatory, harassing, or that infringes the intellectual property, privacy, or publicity rights of any third party.
- Generate content intended to deceive others into believing it depicts a real event that did not occur, particularly in ways that could harm a real person’s reputation, safety, or livelihood.
- Attempt to bypass, disable, or interfere with any content moderation, safety, or rate-limiting systems within the Service.
- Use the Service to generate content that violates the acceptable use policies of our underlying model or payment providers.
- Resell, sublicense, or redistribute access to the Service itself without our written permission.
We reserve the right to remove content, suspend accounts, and report unlawful activity to appropriate authorities where we believe in good faith that a violation of this section has occurred.
6. Mature Content
Certain tools within the Service may, in the future, offer an opt-in mode for mature or editorial-style content generation (“T.S.E. Mode”). This feature is not currently active. When enabled, it will be restricted to verified adult users and subject to additional terms and content restrictions, which will be presented at that time. The prohibitions in Section 5 apply at all times, including to any mature content mode, without exception.
7. Your Content and Ownership
7.1 Your Inputs. You retain ownership of any photos, text prompts, or other materials you upload to the Service (“Inputs”). By uploading Inputs, you grant us a limited license to process them solely for the purpose of providing the Service to you.
7.2 Generated Content. Subject to your compliance with these Terms and payment of applicable fees, you own the Generated Content you create using the Service, to the extent permitted by law. Commercial usage rights vary by subscription tier as described on our Pricing page.
7.3 Our Use. We do not use your private Inputs or Generated Content to train AI models without your consent, and we do not publicly display your private Library contents.
7.4 Storage. Generated Content is saved to your private Library associated with your account. We are not responsible for content loss and recommend downloading or backing up anything important to you.
8. Third-Party AI Models
The Service uses third-party AI infrastructure, including but not limited to models provided by OpenAI, Black Forest Labs (Flux), Replicate, and ElevenLabs. Your use of the Service is also subject to the acceptable use policies of these underlying providers, which may impose additional restrictions.
9. Disclaimers
THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES, ARTIFACTS, OR UNEXPECTED RESULTS. WE DO NOT GUARANTEE THAT GENERATED CONTENT WILL BE ERROR-FREE, ACCURATE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the Service, your Generated Content, or your violation of these Terms.
12. Termination
We may suspend or terminate your account at any time for violation of these Terms, including violations of Section 5. You may terminate your account at any time by contacting us or through your account Settings.
13. Governing Law
These Terms are governed by the laws of the State of Pennsylvania, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Pennsylvania.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
